SERVICES PROVIDED
Rise Again Wellness, operated by Jessica Burgess, provides health coaching programs and private Pilates instruction. Our services are designed to support your wellness goals but are not a substitute for medical advice, diagnosis, or treatment.
USER ELIGIBILITY
You must be at least 18 years old to use our services. By using our services, you represent that you meet this age requirement and have the legal capacity to enter into this agreement.

The health coaching and Pilates instruction provided by Rise Again Wellness and Jessica Burgess are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Our services do not constitute medical advice, mental health counseling, or therapy. We are not licensed healthcare providers, physicians, nutritionists, or registered dietitians.
CONSULT YOUR HEALTHCARE PROVIDER
Before beginning any health coaching program, exercise routine (including Pilates), or making changes to your diet or lifestyle, you should consult with a qualified healthcare professional. This is especially important if you have any pre-existing medical conditions, injuries, or concerns, are pregnant or nursing, are taking medications, or have a history of eating disorders or mental health conditions.
INDIVIDUAL RESULTS MAY VARY
Results from our health coaching and Pilates programs vary from person to person. We make no guarantees regarding specific outcomes, weight loss, fitness improvements, or health benefits. Your success depends on many factors, including your commitment, consistency, individual health status, and circumstances beyond our control.
ASSUMPTION OF RISK
By participating in our services, you acknowledge that physical exercise and lifestyle changes carry inherent risks, including but not limited to muscle strain, injury, cardiovascular stress, or exacerbation of existing conditions. You voluntarily assume all risks associated with participating in our programs and agree to immediately discontinue any activity that causes pain or discomfort.
PERSONAL RESPONSIBILITY

You agree to listen to your body, respect your limitations, and modify or stop any exercise or practice that does not feel appropriate for you. You should never disregard professional medical advice or delay seeking medical attention because of information provided through our services.
SCOPE OF PRACTICE
Our health coaching focuses on goal-setting, accountability, motivation, and general wellness education. Our Pilates instruction focuses on movement, strength, flexibility, and body awareness. We do not provide medical diagnoses, treatment plans, meal plans for medical conditions, physical therapy, or psychotherapy. If you require specialized care, we will refer you to appropriate licensed professionals.
RELEASE OF LIABILITY
To the fullest extent permitted by law, you release and hold harmless Rise Again Wellness, Jessica Burgess, and any affiliated parties from any and all liability, claims, demands, actions, or causes of action arising from injury, illness, or damages of any kind sustained in connection with your participation in our programs or use of our services.
EMERGENCY SITUATIONS
If you experience severe pain, dizziness, shortness of breath, chest pain, or any other concerning symptoms during or after participating in our programs, stop immediately and seek emergency medical attention. Call 911 or go to the nearest emergency room.
CONFIDENTIALITY LIMITS
While we maintain confidentiality of your information as outlined in our Privacy Policy, we are not bound by HIPAA or medical confidentiality regulations. If we believe you are in danger of harming yourself or others, we may be required to report this to appropriate authorities.

PAYMENT & REFUND POLICY

This Payment and Refund Policy outlines the terms for all financial transactions with Rise Again Wellness.
PAYMENT METHODS
Rise Again Wellness accepts payment via Zelle. Full payment details and instructions will be provided upon enrollment in our programs or services. By providing your payment information, you authorize us to charge the agreed-upon fees for services rendered.
PRICING & FEES
All pricing is clearly stated at the time of purchase or enrollment. Prices are subject to change, but any changes will not affect services already purchased. You are responsible for paying the full amount for services as outlined in your program agreement or service package.
PAYMENT TIMING
Payment is required according to the following terms:
• One-time services: Payment is due in full before or at the time of service
• Multi-session packages: Payment is due in full at the time of purchase unless otherwise agreed in writing
• Ongoing programs: Payment schedules will be outlined in your program agreement
LATE PAYMENT
If payment is not received by the due date, we reserve the right to suspend services until payment is made in full. Late payments may result in cancellation of scheduled sessions and forfeiture of any package discounts or promotional pricing.
REFUND POLICY
General Policy: Due to the personalized nature of our health coaching and Pilates services, all sales are generally final. We do not offer refunds for services already rendered or for packages after the first session has been completed.
Early Termination: If you choose to discontinue services after purchasing a multi-session package, you may be eligible for a prorated refund for unused sessions, minus a 25% administrative fee, if requested within 14 days of purchase and before more than two sessions have been completed. Refund requests must be submitted in writing.
Medical or Emergency Circumstances: If you are unable to continue services due to serious medical issues or emergency circumstances, please contact us. We will evaluate refund requests on a case-by-case basis and may require documentation from a healthcare provider.
CANCELLATION POLICY
Session Cancellations: You may cancel or reschedule individual sessions with at least 24 hours notice without penalty. Cancellations made with less than 24 hours notice or no-shows will result in forfeiture of that session with no refund or credit provided.
Provider Cancellations: If we need to cancel a scheduled session, we will provide as much notice as possible and work with you to reschedule. If rescheduling is not possible, you will receive a credit or prorated refund for that session.
PACKAGE EXPIRATION
Multi-session packages must be used within 6 months from the date of purchase unless otherwise specified in writing. Unused sessions after the expiration date are forfeited with no refund. Extensions may be granted in extenuating circumstances at our sole discretion.
PROMOTIONAL OFFERS & DISCOUNTS
Promotional offers, discounts, and special pricing are subject to specific terms and conditions. Promotional packages are typically non-refundable and may have different cancellation policies. Details will be provided at the time of purchase.
CHARGEBACKS & DISPUTES
If you have a concern about a charge, please contact us directly before initiating a chargeback with your payment provider. Initiating a chargeback without first attempting to resolve the issue with us may result in immediate termination of services and may affect your ability to use our services in the future.
REFUND PROCESSING
If a refund is approved, it will be processed within 14 business days and returned via the original payment method. Please allow additional time for your financial institution to process the credit.
CHANGES TO THIS POLICY
We reserve the right to modify this Payment and Refund Policy at any time. Changes will be posted on our website with an updated effective date. Your continued use of our services after changes are posted constitutes acceptance of the updated policy.
